Overview

Essure is the only non-surgical sterilization device on the market. Unlike a traditional tubal ligation (“getting your tubes tied”), Essure is implanted without anesthesia in a 10-minute outpatient procedure.

Essure is implanted through the vagina into each of a woman’s fallopian tubes, where it causes an inflammatory reaction. Over several months, scar-tissue grows around Essure’s metal coils and blocks the fallopian tubes, preventing pregnancy.

Essure Risk of Getting Pregnant

With so-called “perfect use,” Essure is over 99% effective at preventing pregnancy. However, studies of “real world” use have found that up to 9.6% of women get pregnant within 10 years.

Essure Linked to 10X Risk of Follow-Up Surgery

Other studies have found that 2.4% of women who get Essure need follow-up surgery — more than a 10-fold increased risk compared to the 0.2% of women who need follow-up surgery after tubal ligation, according to the British Medical Journal.

Essure Lawyers File $1 Million Claim Against Bayer

Bayer HealthCare and its subsidiary Conceptus Inc. have been sued by several women who were injured by Essure. One victim, Kim Hudak, was a 28 year-old mother who participated in an early clinical trial of the device and experienced severe side effects. Her lawyers have filed a $1 million claim against Bayer seeking reimbursement for injuries and lost wages. According to the New York Times:

“She developed a sharp pain in her right hip that did not go away. Her menstrual periods became very painful, and she developed a slew of symptoms including fatigue, migraines and joint pain that often kept her from working full time.”

Another victim, Heather Walsh, needed five surgeries and a hysterectomy to treat complications of Essure. She was implanted with Essure in October 2008 and suffered from chronic pain, fever, and fainting spells.

Eventually, doctors discovered that Essure had perforated her fallopian tube and migrated into her abdomen and colon. Her case was transferred to Pennsylvania federal court in January 2015 (Case No. 2:15-cv-00384).

What is the problem?

In September 2015, the FDA said it had received 5,093 adverse event reports from women who were injured by Essure. Many of these women have contacted lawyers only to be told that they cannot file a lawsuit due to a federal law known as preemption.

Essure received Pre-Market Approval (PMA) in 2002. This process is supposed to stop frivolous lawsuits by forcing manufacturers to follow rigorous scientific protocols during pre-market studies of new devices. The law shields Conceptus and Bayer from lawsuits involving Essure injuries.

Lawyers are challenging Essure’s PMA by arguing that Conceptus falsified medical records and failed to disclose adverse events, including an internal Excel spreadsheet with 16,047 entries for complaints between 2011 and 2013.
